شروط الاستخدام لمنصة أكاديمية تتبع الاتجاه

1. مقدمة وتعريفات

مرحباً بك في منصة أكاديمية تتبع الاتجاه على الرابط https://trendfollowingacademy.com (ويُشار إليها بـ«المنصة» أو «الأكاديمية» أو «نحن»). باستخدامك للمنصة أو تسجيلك فيها فإنك توافق على هذه الشروط. إذا كنت لا توافق عليها، يُرجى عدم استخدام المنصة.

في هذه الشروط يُقصد بـ:

المدرب: الشخص أو الجهة التي تقدّم الدورة التدريبية وتتعاقد مع المتدرب عليها.
المتدرب: كل شخص مسجّل في المنصة بعد اشتراكه في دورة لدى المدرب.
المحتوى: تسجيلات المحاضرات والدروس والملفات والمواد التعليمية المتاحة على المنصة.

2. طبيعة الخدمة

تُقدَّم المحاضرات بشكل مباشر عبر برنامج زوم الخاص بالمدرب، خارج المنصة.
بعد كل محاضرة تُرفع نسخة مسجّلة منها على المنصة، ليتمكن المتدرب من مشاهدتها في بيئة آمنة خلال مدة اشتراكه.
تتيح المنصة أيضاً مجتمعاً للمتدربين للتفاعل والنقاش.
دور المنصة هو توفير مكان آمن لحفظ المحتوى وعرضه للمتدربين المسجّلين فقط، وإدارة حساباتهم.

3. التسجيل والأهلية

يجب أن يكون عمرك 18 عاماً على الأقل.
التسجيل في المنصة متاح فقط لمن اشترك في دورة لدى المدرب، وأُضيف بريده الإلكتروني إلى قائمة المسموح لهم بالتسجيل.
يجب أن تكون البيانات التي تقدمها عند التسجيل صحيحة ومحدّثة.
الحساب شخصي ولا يجوز مشاركته أو بيعه أو نقله لأي شخص آخر. أنت مسؤول عن الحفاظ على سرية كلمة المرور وعن كل نشاط يتم من خلال حسابك.
يجب إبلاغنا فوراً عند الاشتباه في أي استخدام غير مصرّح به لحسابك على البريد info@trendfollowingacademy.com.

4. الدفع والاسترداد

يتم الدفع مباشرة بين المتدرب والمدرب خارج المنصة، ولا تستقبل المنصة أي مدفوعات ولا تحتفظ بأي بيانات دفع.
المنصة ليست طرفاً في اتفاق الدفع أو الاسترداد بين المتدرب والمدرب. أي طلب يتعلق بالرسوم أو الاسترداد يُوجَّه إلى المدرب مباشرة.

5. مدة الوصول إلى المحتوى

تُحدَّد مدة الوصول إلى محتوى كل دورة بناءً على الاتفاق بين المتدرب والمدرب.
تلتزم المنصة بتطبيق مدة الوصول التي يحددها المدرب، وعند انتهائها يُغلق الوصول إلى محتوى الدورة.

6. الملكية الفكرية وحماية المحتوى

جميع المحتويات على المنصة مملوكة للمدرب أو للأكاديمية أو للمرخّصين لهم، ومحمية بموجب أنظمة حقوق المؤلف والملكية الفكرية.
يُمنح المتدرب حق استخدام شخصي وغير حصري وغير قابل للنقل لمشاهدة المحتوى خلال مدة اشتراكه.
يُمنع منعاً باتاً: تسجيل الشاشة أو تصوير المحاضرات المباشرة أو المسجّلة، أو تنزيل المحتوى أو نسخه أو إعادة نشره أو بيعه أو مشاركته مع أي شخص بأي وسيلة.
مخالفة ذلك تعطي المنصة الحق في إيقاف الحساب فوراً، دون أن يترتب على ذلك أي التزام بالاسترداد، مع حفظ حق المدرب والأكاديمية في اتخاذ الإجراءات النظامية.

7. قواعد المجتمع

عند استخدامك لمجتمع المنصة، أنت توافق على ما يلي:

التعامل باحترام مع الأعضاء الآخرين، وعدم نشر أي محتوى مسيء أو تشهيري أو مخالف للأنظمة.
عدم نشر توصيات شراء أو بيع لأسهم أو أصول مالية بعينها على أنها توصيات للآخرين.
عدم الترويج لقنوات أو خدمات توصيات أو إدارة أموال، أو لأي منتجات وخدمات تجارية، أو نشر روابط إعلانية.
عدم نشر البيانات الشخصية لأي عضو آخر، أو مشاركة ما يُنشر داخل المجتمع خارجه دون إذن صاحبه.
ما ينشره الأعضاء يعبّر عن آرائهم الشخصية فقط، ولا يمثّل رأي الأكاديمية أو المدرب.
يحق للمنصة حذف أي محتوى أو إيقاف أي حساب يخالف هذه القواعد.

8. الطبيعة التعليمية وإخلاء المسؤولية

المنصة تعليمية بحتة، وجميع ما يُقدَّم فيها لأغراض تعليمية وتوعوية فقط.
لا تقدّم الأكاديمية ولا المدربون عبر المنصة خدمات المشورة في الأوراق المالية أو إدارة الأموال أو التوصيات الاستثمارية، وهي أنشطة تتطلب ترخيصاً من هيئة السوق المالية.
أي أمثلة على أسهم أو صفقات تُعرض في المحتوى هي لأغراض الشرح فقط، ولا تُعد توصية بالشراء أو البيع أو الاحتفاظ.
التداول والاستثمار في الأسواق المالية ينطويان على مخاطر عالية، منها خسارة رأس المال كلياً أو جزئياً. أنت وحدك المسؤول عن قراراتك الاستثمارية ونتائجها.

9. حدود المسؤولية

إلى الحد الذي يسمح به النظام، لا تتحمل الأكاديمية أو القائمون عليها أي مسؤولية عن أي خسائر مالية أو أضرار مباشرة أو غير مباشرة تنتج عن استخدامك للمنصة أو للمعلومات الواردة فيها.
لا تتحمل المنصة مسؤولية ما يجري بين المتدرب والمدرب خارجها، بما في ذلك الدفع والاسترداد والمحاضرات المباشرة عبر زوم.

10. توفّر الخدمة

نسعى لإتاحة المنصة بشكل مستمر، لكننا لا نضمن عملها دون انقطاع أو أخطاء. قد تتوقف المنصة مؤقتاً لأعمال الصيانة أو التحديث أو لأسباب خارجة عن إرادتنا.

11. إيقاف الحساب وإنهاؤه

يحق للمنصة إيقاف الحساب أو إنهاؤه عند مخالفة هذه الشروط، أو عند انتهاء مدة الوصول، أو بطلب من المدرب، أو عند الاشتباه في نشاط احتيالي أو استخدام غير مصرّح به. تبقى البنود المتعلقة بالملكية الفكرية وحدود المسؤولية سارية بعد إنهاء الحساب.

12. النظام الحاكم

تخضع هذه الشروط وتُفسَّر وفقاً للأنظمة المعمول بها في المملكة العربية السعودية، وتختص المحاكم السعودية بالنظر في أي نزاع ينشأ عنها.

13. التعديلات على الشروط

قد نحدّث هذه الشروط من وقت لآخر. عند إجراء تغييرات جوهرية سنُعلم المتدربين عبر البريد الإلكتروني أو بإشعار على المنصة. استمرارك في استخدام المنصة بعد التحديث يعني موافقتك على الشروط المحدّثة.

14. اللغة المعتمدة

هذه الشروط متاحة باللغتين العربية والإنجليزية، وفي حال وجود أي اختلاف بينهما يكون النص العربي هو المعتمد.

Terms of Use – Trend Following Academy (English Version)

1. Introduction and Definitions

Welcome to the Trend Following Academy platform at https://trendfollowingacademy.com (the “Platform”, “Academy”, “we”). By using or registering on the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

Instructor: the person or entity that delivers a course and contracts with the trainee for it.
Trainee: any person registered on the Platform after enrolling in a course with an Instructor.
Content: lecture recordings, lessons, files and learning materials available on the Platform.

2. Nature of the Service

Lectures are delivered live via the Instructor’s own Zoom account, outside the Platform.
After each lecture, a recorded copy is uploaded to the Platform so trainees can watch it in a secure environment during their access period.
The Platform also provides a community for trainees to interact and discuss.
The Platform’s role is to provide a secure place to store and present Content to registered trainees only, and to manage their accounts.

3. Registration and Eligibility

You must be at least 18 years old.
Registration is available only to those who enrolled in a course with an Instructor and whose email was added to the list of approved addresses.
The information you provide must be accurate and up to date.
Accounts are personal and may not be shared, sold or transferred. You are responsible for keeping your password confidential and for all activity under your account.
Notify us immediately of any suspected unauthorized use at info@trendfollowingacademy.com.

4. Payment and Refunds

Payment is made directly between the trainee and the Instructor outside the Platform. The Platform does not receive any payments or store any payment details.
The Platform is not a party to any payment or refund arrangement between the trainee and the Instructor. Any request about fees or refunds must be directed to the Instructor.

5. Access Period

The access period for each course’s Content is determined by the agreement between the trainee and the Instructor.
The Platform applies the access period set by the Instructor; when it ends, access to that course’s Content is closed.

6. Intellectual Property and Content Protection

All Content is owned by the Instructor, the Academy or their licensors and is protected by copyright and intellectual property laws.
Trainees receive a personal, non-exclusive, non-transferable right to view the Content during their access period.
Strictly prohibited: screen recording or filming live or recorded lectures, and downloading, copying, republishing, selling or sharing any Content by any means.
Violations entitle the Platform to suspend the account immediately, with no refund obligation, without prejudice to the legal rights of the Instructor and the Academy.

7. Community Rules

Treat other members respectfully; do not post offensive, defamatory or unlawful content.
Do not post buy or sell recommendations for specific stocks or financial assets as advice to others.
Do not promote signal, advisory or money-management channels or services, any commercial products or services, or advertising links.
Do not post other members’ personal data, or share community content outside the Platform without the author’s permission.
Members’ posts reflect their personal views only, not those of the Academy or the Instructor.
The Platform may remove any content or suspend any account that violates these rules.

8. Educational Nature and Disclaimer

The Platform is purely educational; everything provided is for educational and awareness purposes only.
Neither the Academy nor the Instructors provide, through the Platform, securities advisory, money-management or investment recommendation services, which are activities that require a license from the Capital Market Authority.
Any stocks or trades shown in the Content are examples for explanation only and are not a recommendation to buy, sell or hold.
Trading and investing involve high risk, including the loss of all or part of your capital. You alone are responsible for your investment decisions and their results.

9. Limitation of Liability

To the extent permitted by law, the Academy and its operators are not liable for any financial losses or direct or indirect damages arising from your use of the Platform or its information.
The Platform is not responsible for anything between the trainee and the Instructor outside the Platform, including payments, refunds and live Zoom lectures.

10. Service Availability

We aim to keep the Platform available, but do not guarantee uninterrupted or error-free operation. It may be temporarily unavailable for maintenance, updates or reasons beyond our control.

11. Suspension and Termination

The Platform may suspend or terminate an account for violating these Terms, at the end of the access period, at the Instructor’s request, or on suspicion of fraud or unauthorized use. Provisions on intellectual property and limitation of liability survive termination.

12. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia, and Saudi courts have jurisdiction over any dispute arising from them.

13. Changes to These Terms

We may update these Terms from time to time. For material changes we will notify trainees by email or by a notice on the Platform. Continued use after an update means you accept the updated Terms.

سياسة الخصوصية لمنصة أكاديمية تتبع الاتجاه

1. من نحن

أكاديمية تتبع الاتجاه منصة تعليمية على الرابط https://trendfollowingacademy.com، توفّر مكاناً آمناً للمتدربين المسجّلين لمشاهدة تسجيلات الدورات التدريبية والتفاعل في مجتمع المتدربين. توضّح هذه السياسة البيانات الشخصية التي نجمعها، ولماذا نجمعها، وكيف نحميها، وما حقوقك عليها، وذلك وفقاً لنظام حماية البيانات الشخصية في المملكة العربية السعودية.

2. البيانات التي نجمعها

قبل التسجيل: عند اشتراكك في دورة لدى المدرب، يزوّدنا المدرب ببريدك الإلكتروني لإضافته إلى قائمة المسموح لهم بالتسجيل في المنصة.

عند التسجيل: الاسم الأول والأخير، والبريد الإلكتروني، والاسم المستعار الذي يظهر لباقي الأعضاء، وكلمة المرور (تُحفظ مشفّرة ولا يمكننا الاطلاع عليها).

أثناء استخدام المنصة:

بيانات ملفك الشخصي التي تختار إضافتها، مثل الصورة الشخصية والنبذة.
ما تنشره في المجتمع من منشورات وتعليقات ورسائل خاصة، وما ترفعه من صور أو مقاطع فيديو أو ملفات.
تقدّمك في الدورات، مثل الدروس التي شاهدتها ونتائج الاختبارات والشهادات.
بيانات تقنية تُسجَّل تلقائياً لأغراض الأمان وتشغيل المنصة، مثل عنوان IP ونوع المتصفح وأوقات تسجيل الدخول.

عند التواصل معنا: ما ترسله لنا عبر البريد الإلكتروني من بيانات ورسائل.

ما لا نجمعه: لا نجمع أي بيانات دفع، لأن الدفع يتم مباشرة بين المتدرب والمدرب خارج المنصة.

3. لماذا نستخدم بياناتك

التحقق من أهليتك للتسجيل، وإنشاء حسابك وإدارته.
إتاحة محتوى الدورة لك خلال مدة الوصول المتفق عليها مع المدرب.
تشغيل مجتمع المتدربين وإظهار مشاركاتك لباقي الأعضاء.
إرسال رسائل الخدمة، مثل تفعيل الحساب واستعادة كلمة المرور وإشعارات المجتمع.
حماية المنصة ومنع الاستخدام غير المصرّح به والاحتيال.
الالتزام بالأنظمة المعمول بها.

لا نبيع بياناتك، ولا نستخدمها للتسويق لصالح أي جهة أخرى، ولا نستخدم أدوات تحليلات أو إعلانات تابعة لجهات خارجية.

4. مع من نشارك بياناتك

المدرب ومساعدوه: يطّلع مدرب الدورة، ومن يكلّفهم بمتابعة المتدربين مثل قادة المجموعات، على اسمك وبريدك وتقدّمك ونتائجك في الدورة أو المجموعة التي ينتمون إليها، لمتابعة سير الدورة وإدارة مدة الوصول.
أعضاء المجتمع: يظهر اسمك المستعار وملفك الشخصي وما تنشره في المجتمع لباقي الأعضاء المسجّلين.
مزودو الخدمات التقنية: بالقدر اللازم لتشغيل المنصة فقط، وهم: Hostinger لاستضافة الموقع والبريد الإلكتروني، وVimeo لعرض تسجيلات الدورات، وCookieYes لإدارة موافقتك على ملفات تعريف الارتباط، وخدمة Google reCAPTCHA لحماية صفحات الدخول والتسجيل واستعادة كلمة المرور من البرامج الآلية، وهي تجمع بيانات تقنية عن جهازك وتفاعلك مع الصفحة وتخضع لـسياسة خصوصية Google، إضافة إلى شبكات توصيل المحتوى التي تُحمّل منها بعض ملفات تشغيل الموقع، والتي قد يصلها عنوان IP الخاص بك عند تصفّح المنصة.
الجهات الرسمية: عند وجود طلب نظامي من جهة مختصة.

المحاضرات المباشرة عبر زوم: تتم على حساب زوم الخاص بالمدرب خارج المنصة، وتخضع لسياسة الخصوصية الخاصة بشركة زوم ولإدارة المدرب.

5. ملفات تعريف الارتباط (Cookies)

نستخدم ملفات تعريف ارتباط ضرورية لتسجيل دخولك والحفاظ على جلستك وتفضيلات العرض. كما قد يضع مشغّل الفيديو (Vimeo) ملفات تعريف ارتباط خاصة به عند مشاهدة التسجيلات. ويظهر لك عند زيارة المنصة إشعار يتيح لك إدارة موافقتك على ملفات تعريف الارتباط غير الضرورية. يمكنك أيضاً حذف هذه الملفات أو حظرها من إعدادات متصفحك، مع العلم أن حظر الملفات الضرورية قد يمنعك من تسجيل الدخول.

6. مدة الاحتفاظ بالبيانات

نحتفظ ببيانات حسابك طالما بقي حسابك قائماً.
يمكنك حذف حسابك بنفسك في أي وقت من إعدادات حسابك في المنصة، أو بطلب منا عبر البريد. ويؤدي حذف الحساب إلى حذف ملفك الشخصي وما يرتبط به من بيانات.
عند طلبك الحذف عبر البريد، ننفّذه خلال 30 يوماً، باستثناء ما يلزمنا النظام بالاحتفاظ به.

7. حقوقك

وفقاً لنظام حماية البيانات الشخصية، يحق لك:

العلم بكيفية جمع بياناتك واستخدامها، وهو ما توضّحه هذه السياسة.
الاطلاع على بياناتك الشخصية لدينا، والحصول على نسخة منها.
طلب تصحيح بياناتك أو تحديثها.
طلب إتلاف بياناتك عند انتفاء الحاجة إليها.
سحب موافقتك على معالجة بياناتك في أي وقت، مع العلم أن ذلك قد يمنع استمرار حسابك.

لممارسة أي من هذه الحقوق، راسلنا على info@trendfollowingacademy.com، وسنرد على طلبك خلال 30 يوماً. ويحق لك تقديم شكوى إلى الهيئة السعودية للبيانات والذكاء الاصطناعي (سدايا) إذا رأيت أن بياناتك عولجت بما يخالف النظام.

8. حماية بياناتك

نتخذ إجراءات معقولة لحماية بياناتك، منها: تشفير الاتصال بالمنصة (SSL)، وحفظ كلمات المرور مشفّرة، والتحديث الدوري للأنظمة، وتقييد التسجيل بالمتدربين المعتمدين فقط، وحماية صفحات الدخول والتسجيل من البرامج الآلية، وحصر صلاحيات الإدارة في عدد محدود من الأشخاص. ومع ذلك لا يوجد نظام آمن بشكل كامل، لذا نوصيك باستخدام كلمة مرور قوية وعدم مشاركتها. وفي حال وقوع أي حادث يمس بياناتك، سنبلغك والجهات المختصة وفق ما يقتضيه النظام.

9. نقل البيانات خارج المملكة

قد تُستضاف المنصة أو بعض الخدمات التقنية المرتبطة بها على خوادم خارج المملكة العربية السعودية. في هذه الحالة نحرص على أن يتم ذلك وفق الضوابط النظامية لنقل البيانات الشخصية، وبالقدر اللازم لتشغيل المنصة فقط.

10. الفئة العمرية

المنصة موجّهة لمن تبلغ أعمارهم 18 عاماً فأكثر، ولا نجمع عن قصد بيانات من هم دون ذلك.

11. التعديلات على السياسة

قد نحدّث هذه السياسة من وقت لآخر، وسنُعلم المتدربين بأي تغيير جوهري عبر البريد الإلكتروني أو بإشعار على المنصة. وفي حال وجود أي اختلاف بين النسختين العربية والإنجليزية، يكون النص العربي هو المعتمد.

1. Who We Are

Trend Following Academy is an educational platform at https://trendfollowingacademy.com that provides registered trainees with a secure place to watch course recordings and take part in a trainee community. This policy explains what personal data we collect, why, how we protect it and your rights, in line with the Saudi Personal Data Protection Law.

2. Data We Collect

Before registration: when you enroll in a course with an Instructor, the Instructor provides us with your email so it can be added to the list of addresses allowed to register.

At registration: first and last name, email, the nickname shown to other members, and your password (stored encrypted; we cannot view it).

While using the Platform:

Profile details you choose to add, such as a photo and bio.
Posts, comments and private messages you share in the community, and any photos, videos or files you upload.
Your course progress, such as lessons viewed, quiz results and certificates.
Technical data recorded automatically for security and operation, such as IP address, browser type and login times.

When you contact us: the information and messages you send us by email.

What we do not collect: any payment data, since payment is made directly between the trainee and the Instructor outside the Platform.

3. How We Use Your Data

To verify your eligibility, and create and manage your account.
To give you access to course Content during the access period agreed with the Instructor.
To run the trainee community and show your contributions to other members.
To send service emails, such as account activation, password reset and community notifications.
To protect the Platform and prevent unauthorized use and fraud.
To comply with applicable laws.

We do not sell your data, use it for marketing on behalf of others, or use third-party analytics or advertising tools.

4. Who We Share Your Data With

The Instructor and assistants: the course Instructor, and those assigned to follow trainees such as group leaders, can see your name, email, progress and results in their course or group, to follow the course and manage your access period.
Community members: your nickname, profile and community posts are visible to other registered members.
Technical service providers: only as needed to run the Platform: Hostinger (website hosting and email), Vimeo (playing course recordings), CookieYes (cookie consent management), Google reCAPTCHA (protecting login, registration and password-reset pages from bots; it collects technical data about your device and interaction with the page and is subject to the Google Privacy Policy), and content delivery networks that serve some of the site’s files and may receive your IP address when you browse.
Authorities: when legally required by a competent authority.

Live Zoom lectures: take place on the Instructor’s own Zoom account outside the Platform, and are subject to Zoom’s privacy policy and the Instructor’s management.

5. Cookies

We use essential cookies to log you in and keep your session and display preferences. The video player (Vimeo) may also set its own cookies when you watch recordings. A notice on the Platform lets you manage consent for non-essential cookies. You can also delete or block cookies in your browser, though blocking essential cookies may prevent you from logging in.

6. Data Retention

We keep your account data for as long as your account exists.
You can delete your account yourself at any time from your account settings, or ask us by email. Deleting your account removes your profile and its associated data.
Requests made by email are completed within 30 days, except what we are legally required to keep.

7. Your Rights

Under the Personal Data Protection Law, you have the right to: be informed about how your data is collected and used; access your data and obtain a copy; request correction or updates; request destruction of your data when no longer needed; and withdraw your consent at any time (which may end your account).

To exercise these rights, email info@trendfollowingacademy.com; we will respond within 30 days. You may also file a complaint with the Saudi Data and Artificial Intelligence Authority (SDAIA) if you believe your data was processed unlawfully.

8. Protecting Your Data

We take reasonable measures to protect your data, including encrypted connections (SSL), encrypted password storage, regular system updates, limiting registration to approved trainees, protecting login and registration pages from bots, and limiting admin access to a small number of people. No system is completely secure, so please use a strong password and keep it private. If an incident affects your data, we will notify you and the competent authorities as required by law.

9. Transfers Outside the Kingdom

The Platform or some related technical services may be hosted on servers outside Saudi Arabia. Where this happens, we ensure it follows the legal requirements for transferring personal data, and only as needed to run the Platform.

10. Age

The Platform is intended for people aged 18 and over, and we do not knowingly collect data from anyone younger.

11. Changes to This Policy

We may update this policy from time to time and will notify trainees of material changes by email or by a notice on the Platform.
